Legal Question in Workers Comp in Illinois

Light Duty on Workers Compensation

Husband fell off truck at work and broke wrist. He is a truck driver. follow up with doctor again tomorrow to make sure bad break is healing ok. Dr. said ok to light duty but no driving. Employer came back and said that they will have him sit as security guard from 9pm to 5:30 am but the will not pay him his hourly wage. The employer wants to have him paid 66% by work. comp. and then pay him the difference to make up the equivilent of a 40 hour work week. The employer says that they do not have to pay his contract wage because he is not driving for them. My husband makes $28.05 per hour. This does not sound right. Am I correct?

Re: Light Duty on Workers Compensation

Dear Sirs:

There may be a way of having more than what is being paid. Much will depend on how his gross weekly wage is calculated.

Please call to discuss.

Many thanks,
