Legal Question in Workers Comp in Illinois

Loss of limb settlement amount

I was injured in the mines while working. I was off work for three months. They have now offered me a settlement amount. It shows- 40% of the index finger, 25% of the middle finger and 100% loss of use of the ring finger, all on the right hand. I have also lost 50% strength in this hand. they have offered me 22,124.82. This seems low to me. Please let me know what you think.

Re: Loss of limb settlement amount

I am an attorney in Illinois. I have translated the amount offered you and it tells me the insurance company says your AVERAGE WEEKLY WAGE is $741.20. If this isn't close to what you were making, you should check their figures. But assuming the weekly wage is correct, I can't tell you if you have 25% loss of one finger or more. The ring finger is probably 100% loss or they wouldn't offer that amount to you. But you really have a loss of use of a hand and NOT loss of use of fingers. If your case can be transformed into a hand case, a 50% loss of a hand would bring you $42,248.40. It is possible that it is worth even more than that. Of course, it might be worth less too. But I don't know if you can do this without a lawyer. I can help you with this if you are close to the Chicago area.
