Lump sum
My husband was in an accident with a company vehicle, 1 month shy of 2 yrs. ago. I've heard the work. comp. co. will offer him a lump sum, but I'm not sure if that's true? He's off of WC as of about 7 months ago. Is a lump sum automatic? When is it given?

Lump sum settlements are a product of negotiation based upon the nature and extent of the injuries.
Also, there may be other remdies as well that your husband can pursue.

No!
There is no automatic lump sum paid, you need an attorney because you have a statute of limitations issue with the accident if your husband was not the negligent party.
You then need to make sure that a worker's compensation application has been filed at the Workers' Compensation Commission to preserve any time deadline issues with that claim. While Workers Compensation claims are 3 years before the limitations period runs it would not hurt nor cost any money to file a formal application.
Please see a qualified attorney quickly. An attorney will negotiate you a sum larger than the cost of the 20% fee so you should be better off almost always with the representation of qualified counsel.

It's not automatic and you have only three years from the accident date likely to file a claim. Plus, there is a two year time limit to file a car accident lawsuit. In other words, we highly recommend that you get a competent attorney before it's too late. We have never seen someone get more without a lawyer than they would have with good representation. Do not wait to file a claim. The insurance company will not voluntarily make an offer to your husband. Retain an attorney.
