Legal Question in Workers Comp in Illinois
Let's do the math
Can someone please explain the criteria used in the settlement process. I'm not trying to second guess my attorney but just trying to keep them honest. I know they must bring all offers to the client no matter how bad they might be. SO; How is this calculated? Percentage of disability, lost wages, potential future lost income, age, income at time of injury. What is the formula?

Re: Let's do the math
Generally, the following factors go in to the calculation:
1. Was your injury pre 1996 or after?
2. What is yor compensation rate
3. What is the nature of your injury
4. What are your annual medical bills
5. Is your case in litigation or has it been recently?
6. Are you subject to a 500 week maximum of compensation (different factors may indicate this).
7. Where do you live (Phila. or elsewhere)
8. Does your attorney specialize in comp. work.?
These are several of the factors that go into the calculation. In order to tell if you are getting a fair settlement, feel free to email specific information.
