Legal Question in Workers Comp in Illinois

Need MRI

I fell at work. Fratured two fingers and received 7 stitches on my knee. My upper arm is also very sore. Work doctor took x-rays of fingers, knee and shoulder. Nothing broke in shoulder-but very painful. My own Dr. has suggested MRI to see if everything is ok. WC is ignoring phone calls on this..

Sounds like you could use the help of an experienced attorney. Don't kid yourself - you have had a serious injury and if your knee MRI comes back showing any further damage, your case is that much more serious. When you say your doctor "suggested" a MRI does that mean he gave you a written prescription for the test or jest "suggested" it?

You need to obtain and provide a copy of a written prescription to the adjuster and demand the "authorization" of the procedure.

Tell them that "Section 8(a)" provides for this benefit.

Just to clarify previous answers by other attorneys - There are no "motions to compel" in Worker's Compensation and you do NOT need to pay for the procedure first. The insurance company needs contact the medical provider to guarantee the payment of the bill. The process is called "authorization".

The employer - their insurance carrier - are obligated to "authorize" medical treatment, including diagnostic testing, for conditions related to a compensable work accident.

If the adjuster does NOT authorize the procedure - or ignores you - you need to find an attorney.

An attorney will file an 8(a) petition and an Application for Adjustment of Claim. That should be enough to get the procedure authorized.

This is a situation that I encounter on a too-frequent basis.
