Legal Question in Workers Comp in Illinois
Ppd %
What is the usual % of PPD for a knee that has had surgery because of an ''extensive oblique to horizontal tear involving the posterior horn of the medial meniscus which extends into the body of the medial meniscus and continues to envolve the anterior horn of the medial miniscus''. I was hurt at work, had surgery, and now am trying to find out about about the PPD %. I kind of know how this works but I want to find out if the attorney I have talked with is correct when he has stated that this injury/surgery is anywhere from 16% to 18% PPD. I know there is a big book out there that pretty much has all this figured out already. So, is this right? 16 to 18 % ?

Re: Ppd %
I am quite certain that a lawyer for an insurance company told you that because if you had your own attorney you would never settle your case for such a low amount.
Over and over again, I tell people that if you have a lawyer in a workers' compensation case you will wind up with more money in your pocket, generally, than if you do not have a lawyer.
I would suggest that you contact an attorney who is well versed in workers' compensation laws and bring your medical records with you.
I suspect that you will find that with an attorney you will still walk away with more than you can obtain solo.
I am just glad that you asked now before it was too late!
Good luck,

Re: Ppd %
I'm a little late here and I hope you haven't accepted a settlement at or near 16-18%. Since no one has actually responded as to the amount you should expect, I thought I would for you.
Generally, for a meniscus tear with a surgery, cases settle anywhere between 15 to 30%, depending on the outcome of your surgery, whether you have any permanent restrictions and a host of other factors. But, usually, if an attorney is involved, we can secure a settlement of around 20-25% minimum.
The insurance company will tell you that you are saving attorneys fees by taking 16 or 18%, but the difference between getting 16 or 18% versus getting 20-25% is very significant and would more than cover the attorneys fees.
I have handled hundreds of similar meniscus injuries. I'd be happy to help with your case if its not too late already. Feel free to call or e-mail at the information below.
Either way, good luck!
