Previous Back injury and Workers Comp
I had spine surgery 4 yrs ago (not work related). I have Spondyolisthesis Grade IV (Severe Condition). I was in a car accident recently while working. I filed a WC claim - was off for 6 wks before receiving 1st check. Then took 2 months to receive another check. WC has interfered with treatments - and has closed cased bc I had previous surgery and independent doctor stated I have reached MMI bc I will never be 100% again. Its been 6 months no income - lawyers states we should settle. I dont want to settle - still being treated and need spine shots. Doctors have not released me (spine doctor nor Company doctor). Was just fired last week and no longer have health insurance - cant get spine shots. Am in lots of pain - very limited in what I can do. Am I out of luck because I will never be 100% better. Have filed for food stamps - was denied - have no income - can loose home - applied for disability but will take long to determine.

You are entitled to get a medical opinions from a doctor of your choice. If your attorney is not helpful, you should change and get one attorney who is willing to fight for you.
Talk to your attorney and ask to see if he can send you to be examined by your won doctor if you do not feel you are up to going back to work.
