Legal Question in Workers Comp in Illinois

rehab reimbursement

My wife has been diagnosed with carpal tunnel in both arms. She initially went to a doctor of her choosing to verify this and when she was confirmed she informed her work about it. The doctor recommended therapy first which is what she wanted and it was starting to do some good however, the doctor is in another town approximately 30 miles away. The question is does W/C or her employer have to pay her for gas to go from home to rehab or to see the doctor?

Re: rehab reimbursement

You do not tell us whether you are represented by an attorney or not. If so, you should direct your questions to an attorney. If not, there are many attorneys who can provide you with valuable assistance and advice to be sure that you receive all of the benefits that you are entitled to receive. If you do not know such an attorney, you may call me and I will refer you to one of the very best worker's compensation attorneys around.

Re: rehab reimbursement

Dear Sirs:

The price of gasoline is normally not considered a "medical expense" compensable under the Illinois Workmen's Compensation Act.

There are however ways of obtaining a lump sum settlement that will ultimately pay for these expenses indirectly.

Please call so that we may discuss.

Many thanks,

Re: rehab reimbursement

The short answer is no.

However, why do you have to go to that facility? Perhaps it would be more helpful if you went to a closer physical therapy center.

Midwest Physical Therapy is at 513 4th Ave in Rochelle, IL 61068.

See if you feel comfortable there and

get some feedback from your doctor.

Or, you could be referred to a closer doctor for the "management" of the therapy and after the therapy is complete, you can drive out to surgeon for evaluation.

As you only get two "groups" of doctors just make sure any referral is in writing and the insurance company will have to authorize and pay for the treatment.

Just a suggestion. Let me know if you need more particular assistance.

Good luck,

Matt Belcher
