Legal Question in Workers Comp in Illinois
release of my medical records
my employers work comp attorney has subpoena'd my medical records from my personal M.D, which contains some confidential info. I did see my personal M.D. after my injury for the injury. Is my personal M.D. obligated to disclose my confidential info without me signing a release of records? I was told from a friend, that my M.D. will have to release it, is that true? My injury is to my foot, and not related to the confidential info.

Likely so. When you make a claim of personal injury you waive confidentiality. It will, however, be the job of your attorney to make sure that the information considered by the arbitrators and/or the adjusters are the info that is relevant to your case and not anything else.
