Legal Question in Workers Comp in Illinois
I am running out of money
I was hurt accident at work on 7/14/99. Herniated disc L4-L5. off work from 11/10/99 till 6/4/00 under doctor's care. back to work 6/26/00. I worked until 11/8/00 reinjured same disc again off work under doc's care. two wks prior to 11/8/00 I received a final settlement offer from the ins co. I have not signed this offer + I have not received any money from the ins co since the last check which was dated 4/26/99. I talked to my lawyer on 12/13/00 and he told me that the ins co is
''experiencing considerable financial difficulty'' and he ''has personally seen at least 4 of their attorneys leave and take jobs with other law firms'' and ''has no certain info that the co will go bankrupt'' and ''the rumors are quite consistent and certainly indicate that the co is teetering''
Approx 3 days later in the mail I got a letter from my lawyer with a signed copy (by the ins adj) of the previous final offer and he says that
''it appears that the co has entered into an agreement with the Cal Depart of Ins which will temporarily allow them to conduct business as usual'' and he has heard ''additional rumors that the law firm handling there cases will close its doors on Feb 14, 2001.
Can someone please help me

Re: I am running out of money
Your questions says you are in Illinois and that you have a lawyer. I would assume that your lawyer knows what he is doing. You should probably follow his advice. However, you do not indentify the insurance company. If they do go bankrupt the State of Illinois has a backup fund. It's called the Illinois Guarantee Fund. If your condition is as bad as you say, you may not want to settle your case. At least not now. You also don't indentify who your employer is. If it is a substantial employer, you also may not want to settle your claim. These are all factors you should take into account and discuss with your lawyer. If you are not satisfied with the answers you get and are in the Chicago area, I may be willing to help you if you call me at 312-913-1900. In the meantime, you should prepare for a long period of time with no money. You don't give your age or maital status, but you may well have to rely on friends and relatives for basic support. Good Luck. Joe Spingola
