I have not read any of the prior responses, but in my opinion you should definitely consult with an attorney who handles worker's compensation claims without further delay. If you do not already know a worker's compensation attorney, I'm sure that the other attorneys who responded to your question would be helpful. Yes.

The exact amounts cannot be determined now, but in 6-8 months after surgery when you have reached "maximum medical improvement" and it will be effected by your work restrictions, if any.

Generally, those who have the help of an attorney in these types of situation end up with a better settlement.

You should remember that none of the people you will be dealing with (with the exception of MAYBE your doctor) are your friends. No one will be looking out for your interest unless you have an attorney to make sure that your interest is taken into account when comes time to make decisions about the extent of your treatment, its nature and when comes time to assess how serious it is for the purposes of settlement negotiations.

At this point, there are many forces that are in motion against you. I don't mean to scare you, but that is simply the nature of things.

I suggest you get an attorney to discuss the details of your case and see what sort of results would be reasonable to expect.

Yes. Under the Workers' Compensation Act, you are entitled to a settlement after you have finished your medical treatment. The amount can vary depending on many factors, including the severity of your injury, the surgery you went through, your average weekly wage, etc.

Since there are many factors, I would highly recommend you consult with an attorney to see what you should reasonably expect to get for your injury. If you do not hire an attorney, the insurance company will do all they can to save a buck and you likely could get much more. You should at least speak to an attorney so that you are armed with the knowledge of exactly what your injury is worth.
