Legal Question in Workers Comp in Illinois
Ten years ago I got injured at work, the injured areas were my shoulders and neck. So my husband and I decided to sue after three surgeries to try and fix the injuries, fast forward to today things have started to move forward. Recently we received some information from our lawyer saying that one of my old physical therapists has written down in his report that the neck injury that I received was from an unrelated car accident around the same time, possibly destroying our case. What I am trying to ask is, during my time with my physical therapist we had constant arguments about us not paying him on time, because we do not have insurance at the time. We owe him at least $20,000, I was wondering if this can qualify as conflict of interest on his part. Any type of legal advice can go a long way.

The fact that you had diagreements with him may go towards his credibility but that is about it. In fact, he may even have some kind of lien and it is in his interest that you do well. the real issue is did you have a car accident in which you injured your neck. I might add that a PT is not usually qualified to testify concerning diagnosis and causation.
