I failed to mention that my employer is self insured. I know this shouldn't make much off a difference. At this time my employer is saying that I am abandoning my job. The rehab nurse that was handling my case was told that the book is closed on my case and that she could no longer talk to me. oh by the way I work for one of the biggest counties in the state. So I have personal telling me I can't return because of doctor restrictions and risk management telling me to come back as per a F.C.E. report which by the way has restrictions. Typical county red tape no wonder why their $500,000,000 in debt!!!

You need to sit down with an attorney - this is a complex case and you and your lawyer need to review the time line of events.
But from the info you have provided, it still indicates that your treating physician has given you certain restrictions which your employer cannot accommodate; which means, (whether self-insured or not) that you are entitled to be paid "maintenance" at MMI and TTD until you reach MMI - or - be placed in a job within your restrictions and paid wages equal to (at least) your TTD rate.
