Unemployment Insurance after Workmans Compensation
Husband was injurred 2/01, collected workmans compensation through 5/02, released to return to work 5/13, after having back surgery... work laid him off due to lack of work.. applying for unemployment, he only qualifies for $126.00 a week since the base period was 1/01-12/31 and they based this amount of the 2 months he worked in 2001..I've read on internet that they would possibly use different base period for calculation of unemployment for workmans compensations case.. after speaking with local office, they have indicated this only applies if their off of work for 1 year or less.. there is nothing out there to protect a worker who is collecting workmans compensation for more than 1 year.. it appears he is being penalized for workmans compenstaion stringing him along... do we have any other recourse.. We do have a lawyer for workmans compensation, but he does not know the laws with the unemployement.

You should talk to a lawyer who knows the laws of unemployment compensation. You lawyer should have someone that he can refer you to.
