Legal Question in Workers Comp in Illinois

Work Comp

My mom has settled a work comp case through the Illinois Industrial Commission. Her attorney has received his pay. Problem is there is still on medical bill not paid that was part of the settlement. My mom is paying the bill because it is in collections. Everytime she calls her attorney she gets a run around. He is either not in or his assistant says she is working on it. The settlement was 1 1/2 years ago. How can she get the insurance company to pay this bill- why won't her attoney help her- isn't he still obligated

We have considered filing a complaint about him to the attorney registration- but does that really make a difference. He became very angry when we threatened it

Re: Work Comp

All medical bills related to the treatment resulting from injuries sustained at work should have been paid by the worker's compensation insurance. If there are unpaid bills you must find out the reason why they have not been paid.

Write down your question about the unpaid bills and include the unpaid bill and send it all certified mail to your attorney asking him for an explanation. Give him two weeks to respond. If he does not, then file a complaint with the ARDC and have them inquire into it. He will have to respond to the inquiry by the ARDC.

Then you will know what the situation is. Do give him a chance to explain himself in writing. Don't get angry or insulting... just ask simple quesiton, nicely and precisely.

I hope this helps
