You are certainly free to negotiate some settlement with the insurance company without a lawyer. However, you do so at your own risk. The first question you need to answer is "Should/Can this case/claim be settled?" In many cases the answer is "No." The insurance company knows the system and the values. You don't. Only an experienced attorney puts you on an even playing field with the insurance company. Therefore, while you can try to settle your own case, it is not the prudent way to proceed. In the long run, an attorney is usually worth every bit of the fee he eventually gets.

Although you may feel that the insurance company is giving you a fair shake, you may be entitled to more than they are telling you. For instance, in addition to paying for the medical bills, you may be entitled to a portion of your salary while you are recovering. They don't "have to" offer a settlement, but an attorney would get you one and would get you more than you could on your own, even after our 20% fee. Also, no way to tell you what your case is worth right now. It might not be a good idea to settle if you need additional treatment in the future (e.g. if you had a fusion, good chance that you will need it re-done in 10-15 years) and we could arrange for your medical rights to stay open for your life while still getting you money for your injury. Finally, remember that a good lawyer is like a security blanket in case they mess with you. It's better to have a case formally filed with a lawyer than to wait until something goes wrong.
