Legal Question in Workers Comp in Illinois

Work Related Injury

On Nov 20,1994, I was shot in a robbery where I worked. I was told at the time of settlement I didnt need a lawyer. I was under alot of stress at the time and alot of medication. I signed a letter that stated They were no longer liable for any medical expenses after I signed the paper. Now that it is almost 7 years later I am in severe pain because I still have bullet fragments in my back. I was wondering if I could go back and take legal action because of all the stress I was under for being shot? I wasnt in the right frame of mind When I signed the paper. I had a mild breakdown because of the incident. Whats your opinion?

Well.. this is a tricky one. In what I can understand from what you have written, you have signed a release of all claims against the defendant. That is essentially a contract and unless you can show some sort of coersion or fraud, from what I can gather, you are bound by it. You need to consult with a lawyer in your community and show him all the papers and talk in more detail to make a thorough assessement of your situation. I hope this helps. Good luck

You don't want my opinion. To me you "took the money" and ran 7 years ago. You probably didn't have a lawyer and you probably didn't want a lawyer to make any money then. So, you made a bad deal with no advice and gambled your future for a few bucks. Now the chickens are coming home to roost. The insurance companies love fools like you. It's too late to go back in time. Accept the fact that you are an idiot to try to practice law without a license.
