Legal Question in Workers Comp in Illinois
worker's right to choose physician
The Nurse Case Manager on my WC case is insisting I seek rehabilitation therapy at a clinic of her choosing.
I am satisfied with where I am receiving therapy and have been seeing the same person from the outset of my injury.
By law, am I entitled to choose my own doctor? I know I must submit to an IME if requested to do so by the WC Adjuster and I do not object to that.
I do, however, object to their being able to tell me to see who they prefer rather than who I prefer.
What are my rights here?
Thank you for your time.

You are entitled to choose your own doctor and treatment facilities.

Answer: Yes, you do not even need to speak with the Nurse Case Manager.
I would revoke your medical authorization with the Nurse and call the insurance company claim rep. and advise the rep. to either provide someone who will treat you with the respect you deserve or you will not allow case management.
You would then make sure that the off-work slips, doctor's orders and records go directly to the insurance company.
Nurse Case Managers are almost NEVER allowed on one of my claims.
Good luck and keep me posted,
