Legal Question in Workers Comp in Illinois

Do not really know how workers comp works

I had folded my ankle in half at work and doctors did'nt even take an MRI to see how bad ligements and muscles are. I have never been on workers comp before and would like to know if I will be compensated with a settlement also would like to know since they didn't take an MRI what happens if I have trouble down the road with my ankle if the ligements and muscles did not heal right.

Thank you

Re: Do not really know how workers comp works

I'm an attorney in Illinois. It appears to me that you are in Indiana. The laws differ from state to state. The doctors you have seen may not have taken an MRI because they work for either your employer or are part of an HMO or other managed care system. Under those circumstances, the doctor would not be motivated to do all the tests that a private physician might. You should contact an attorney in your area that concentrates in Work Comp to prepare a case for you that will document the extent of any permanent injury that you may have. Only when you can show a work comp insurance company that you have some permanent injury will they make a settlement with you. If you have difficulty finding a lawyer in Indiana to handle your case, that is because the state of Indiana does not provide good benefits to injured workers. As a result, there is not enough money for lawyers to be fairly compensated for their work. Thus, then turn down a lot of the cases. That allows the insurance companies to control your medical and the outcome of your claim. I hope this is of some help to you.
