workers compensation multiple doctors
I have seen my orthopedic surgeon that states I need surgery on my rotator cuff. My surgery is scheduled for July 17, 2009. I was then sent to Chicago to see an IME. I did not get a clear answer from him and he was unable to read my MRI from the disc. Does my first opinion count from my doctor? Or can what the insurance doctor says affect my claim?

The insurance company, along with the IME doctor, like to go back and forth, but a diligent attorney can assist you greatly.

You really need to speak with an attorney.
The IME doctor is not "independent", he or she is hired by the insurance company to find a reason not to pay for the surgery. Some IME doctors are complete whores - some are just trying to make a living - but you need someone to represent your interest in this case.
Moreover, an attorney generally will only cost you 20% of your permanent injury award BUT will almost always result in you obtaining more money in your pocket.
Please contact a qualified attorney immediately as only an attorney can adequately represent your interest before an arbitrator. Tell that person to file an 8(a) petition and a request for a hearing, so that the judge can decide who is more credible - your treating physician or the retained expert.

Dear Sirs,
Your treating drs will be able to set forth their opinions.
Ultimately if the matter cannot be resolved through negotiation, the Arbitrator would have to decide the issue.
