Workers' compensation question

my husband tore tendons at work back almost a yr now & is now on PT....today the head boss brought him in & said he thinks he is faking & suspended him for 10 days....is that allowed?

The answer to your question may depend upon various factors which were not mentioned in your post. Obviously, your husband should have an attorney representing him on hte worker's compensation claim, and that attorney may also be able o help with the suspension issue. If you do not already have an attorney, and if you are located in the central to southern part of the stae, I believe that I could refer you to an excellent attorney. Since no one has bothered to actually answer the question, I will try to help.

The answer is no.

That is not allowed.

If you husband was injured at work he cannot be fired or suspended in retaliation for seeking benefits under the Act.

He can still be fired, but the employer must need a real reason to fire him.

The fact that the boss "thinks he's faking" does not sound like a good faith neutral basis for disciplinary action against your husband.

You should probably start to seek out a lawyer to help with your case.

What attorney Belcher said is correct and is a sound advice. Just delete the other responses specially the patently non-answer advertisement one.

You should seek an attorney as soon as possible so that your husband may be compensated for his loss.
