Workers Compensation Questions

Hurt in ILLINOIS on the job, company is located in MISSOURI, do I have a claim with both states or one or the other. Hurt back Oct 2001, surgery Aug 2002, recieving excellant care, doctor says out of work 3-6 months, been told should get settlement from insurance company, if I get settlement, is care already recieved, IE surgery cost, taken from settlement, should I also ask for open end medical care for the future, another words, besides money, request for future medical help. Surgery: removed disk and also fusion done. Will age come into consideration for settlement.What is Illinois Industrial Commission, is there a statue of limitation? Where does money come from in settlements, company I work for? I have contacted 2 or 3 attorneys but getting 2 or 3 different responses, please advise. Thanks

You have a very complicated situation, and one that does not lend itself to easy answer, hence the varied answers from varied attorneys. You have a right to Compensation under Missouri law and Illinois law. What you choose to pursue will depend on a careful analysis of the benefits, and that is difficult to do via email.

Your settlement should not include your surgery and past medical- that is additional and Work Comp has to pay your medical. Likewise with your past lost wages, or temporary total disability.

It will be difficult to include future medical, or hold that open, without some medical indication that you will need more medical.
