Legal Question in Administrative Law in India
Cut off date on promotions
I am an employee with Nationalised Bank with 25 years as Officer. I was awarded Major punishment by the Bank on 22.05.07 to which I appealed in June 2007 to the Executive Director of the Bank to exonerate me from the charges. It is learnt that the Disciplinary Authority was in favor of awarding me minor punishment & recommend me for the Promotion to the next higher of scale... But bank's CVO objected to it & made the D.A. pass the Major punishment & thus promotion was denied to me.. To my appeal too the appelate authority was in favor of giving minor punishment but here again the Chief Vigilance Officer intervened & made the Exective Director passed the order for major punishment reducing the monetary punishemnt... My interview for the higher post was originally scheduled on 22nd April 08.. I preferred an appeal against the order of the Executive Director on 14th April 08 to the Chairman & Mg. Director for review.. CMD is inclined to reduce my punishment as Minor thus making me eligible for further promotion on 19th April 08... However the cut off date for eligiblility is fixed as 15th March 08... The CMD's review order becomes operative from 22nd May 07.. Under circumstances can I demand as right to be called for the interview?
