Legal Question in Administrative Law in India
can any state government employee be made recovery of salary of his serving period after retirement , due to not passing of department tests.

There are contradictory judgments on this point.
First is your service rules which needs to be scrutinized which changes from State to State.
Ideally, after 4 years, no recovery can be made.
For occasioning recovery, notice of hearing is a must.
If the amount is paid without any misrepresentation on part of the employee, it ideally cant be recovered as such.
