Legal Question in Administrative Law in India
Time limit for an appeal
Dear Sirs
My wife and me have filed a suit in high court in India, challenging our suspensions and for conducting invalid election by not intimating about 400 members whose membership was in dispute and sought an interim prayer to restrain the new executive comite from functioning and for adv comsnr appointment.
All the applications have been dismissed with the judge favouring the defendants supre court case law that one who joins voluntary in an association to abide by the decision and court cannot interfere and so the suspension held valid. with regard to the 400 memebrs since it was in dispute they were not considered and the election is unanimous and hence no order to restrain the ec from functioning or adv comsnr to conduct fresh elections.
All good points I relied upon was not stated in the judgement like if membership dispute exists election notices to be only after dispute is settled, suspensions not valid after the term is over etc.
1) Will it be too late if I go to India after 45 days and appear in person to appeal; 2) can I finsih in three months; 3) Within how many days must I appeal? Pls help as I am fighting for a cause.

Re: Time limit for an appeal
before advising anything we have to see the bye-laws/ rules and regulations/ guidelines of your association. Generally the appeal period from the lower to the higher court is 90 days but if it is an appeal from the Bombay city civil court to Bombay High court, it will be 30 days only. for further clarification and prior appointment you can call us on 28904722/ 9892193167/ 9930093853.
