Legal Question in Administrative Law in India
Is it valid if Judge orders for investigation--though it is not in main suit?
Dear Sirs
In city civil court only the meetings held are challenged but not about 400members dispute.
The defendants filed crp and High Court Judge stayed the lower court order appointing adv comsnr and also mentioned that the lower court to thoroughly investigate the contentious issues of suspension and 400members in dispute.
My question is, will it be valid and legal for the lower court to deal with directions of the high court, since the issue about 400members is not in the main suit and defendants might protest saying that it is not part of the main suit?
or Do I have to file a fresh application based on high court judges directions to investigate about the 400 members not being admitted?
