Is Contempt Case Possible?

A Writ was issued by Hon'ble High Court against the Registration Department for giving entire records of a Particular Document. The Registration Department escaped stating that the records are with the trial court. But the actual fact is that only one record of this document is with the trial court.

The Hon'ble High Court Directed the Trial Court to give that one record and the writ was disposed off.

Now when the petitioner of the writ approaches the Registration Department for the remaining records of that particular document under RTI Act, The Registration Department ignores that request, even though they were defeated in the writ.

The Cheif Information Commissioner inspite of being aware that the Writ is against the Registration Department, hesitates to impose penalty under RTI Act.

Since the Writ was not fully satisfied as only one record was obtained, Can we proceed for a Contempt Case saying that the Registration Department is not giving the remaining records even under RTI Act.

Contempt of Court is maintainable in the same Court, i.e., High Court.

You may approach the High Court under Contempt of Courts Act.
