Mr. Hari and Mr. Veer are good friends. They have been residing in Yadavnagar society of town Amalpur (State Ranpradesh) from last 20 years. Their house number is L1 and L2 respectively. Mr. Raman has been residing just opposite to L-1 in the house number L-14 from last 10 years. There are total 26 houses, situated in two row in Yadavnagar society.

Mr. Raman is a music teacher and he runs music school in his own house. He takes great care that the noise of the music should not disturb the other residents of the society. He also makes riyaz in the morning, sitting in the terrace and playing veena. It disturbs the sleep of the residents of Yadavnagar society particularly Mr. Hari and his old father. Mr. Hari�s elder daughter also gets disturbed by this riyaz as she reads in the morning. She is preparing for her IAS examination. Mr. Hari and Veer has tried to convinve Mr. Raman for doing riyaz in the room and not on the terrace but he is not ready to listen.

Mr. Hari�s son Taman is very mischievous. Master Taman has found a new game of throwing stones on the roofs of the house. Mr. Hari and his wife Kamla used to scold Taman. They take a great care that Taman should not play while the music classes are conducted by Mr. Raman. But sometimes the boy used to play with stones in the absence of his parents. Mr. Veer used to take him when such incident takes place.

On 31st December Mr.Hari and Mr. Veer had gone out of station. Master Taman was playing with his friends the game of hide and seeks in the common plot of the society. During this game they started shouting out of excitement. During this game master Taman went inside the house of Mr. Raman to hide himself. Mr. Raman saw this and scolded him. Out of anger Mr. Raman brought a big stick and approached towards Taman saying that he would injure the legs of Taman so that he could not play again. Mr. Taman got frightened and he threw a stone on Mr. Raman which injured the right eye of Mr. Raman.

Mr. Raman filed a suit against Mr. Hari and his son.

The lower court has decided in favour of Mr. Hari. The matter is pending in the high court of Ranpradesh.
