Legal Question in Appeals and Writs in India

regarding resumption of shop in huda

we have been fighting case against huda since 7 years back in a civil court, now it has been dismissed one month ago,it is now appealed in dist. court but someone has told us to withdraw the appeal from district court and make a application to huda administrator regarding resumption.please suggest the right procedure

The facts given in your statement are not sufficient for an appropriate opinion.

However, if at this stage, your appeal before the Administrator may be barred by time. If at all you would like to choose this course, you may consider filing an application in the appellate court (DJ) making a prayer for withdrawal of appeal subject to the condition that you may be allowed to file an appeal before the Administrator and that the time spent by you in trial court be excluded for calculating limitation period.
