Legal Question in Banking Law in India
We are 5 brothers and 2 sisters who are the legal heirs of my father who died intestate. Only 3 brothers have my father's details of deposits and they are refusing to divulge. I mean is there a way through court to go ahead and partition the movable assets of which only 3 brothers know about and refuse to divulge any details. They work in bank and we don't know which bank were the deposits in. They may also completely deny in court that they know anything about it.
I know the details of the account from which a money order was made to take it into some other account of my father. Is there a legal procedure to get information from this bank to divulge the details and tell me which bank the money was shifted to from their bank.

File a suit for partition and accounting against the 3 brothers impleading the other heirs. Deliver interoogatories. Give details of the banks to which moneys were sent by your father. If u believe that some bank branch had your father's account, you can with the death certificate of your father ask them to disclose the deposits had by your father.
