Legal Question in Banking Law in India
Should or can a banker resort to the powers under s.13[2] & s.13[4] of the sarfaesi act. without exhausting the options u/s 9 of the said act, viz a one time settlement etc. or is it that it is bank discretion to choose any option u/s 9 of the sarfaesi act unilaterally since it appears s.13 is not independent of s.9
