if any accused under 138 negotiable instrument act i.e cheque dishonor case given in written that he will pay the cheque amount by next date if ahe fail to pay can the judger have power to punish him under negotiable instrument act.

it depends.. if u have given it in written then u can be punished in certain conditions and if u have not given in written then it should not be admission.

If an accused gives in writing that he would pay the cheque amount the next hearing date, it amounts to admission of the facts inthe complaint and if he fails to pay, the Judge can convict him based on his own admission.
