Legal Question in Banking Law in India
my brother cunningly got my fathers land leased for 10 years & also got him signed as a guarantor to his bank loan , not only this he has kept the property deeds in liuen with the bank. now after 3 yrs the bank called my father who is 70 yrs old & handed him a 13 (2) notice for an ammount of Rs. 2.34 Crores loan allocated in three accounts after which he is in a dilemma.
kindly help as my father fears life threat as the brother has served 6 court cases against my father & me seeking eviction from the property. which he has pointed as a reason for non payment of banks dues whereas he has invested the money in purchasing a factory in other name.
kindly advice as the current cost of the property is 1/6 th in comparision to the loan granted
