Legal Question in Banking Law in India
My Brother has received a cheque of Rs13000/ from Mr. ABC. The cheque has been dihonoured by the bank. Please guide me. If he will suite Mrs ABC in a court of law, if yes then how?

u need to send a notice first within a month of bouncing.

your brother has two fold remedy. One he may file criminal complaint against ABC under sec 138 Neg Inst Act after giving notice to make good the cheque. Secondly, in addition, he may file a civil summary suit for recovery with interest under order 37 CPC
