Legal Question in Banking Law in India

Check Bounce

I have hired a maid from a placement agency and paid him the contract amount. Now the maid returned to him and he paid me half amount in cash and half in check. Check bounced. I have his office address and i have his numbers -cell and others as well. How to send a legal notice to him. What is the procedure. Do i need to go to police to file a complaint? if yes to police then which one its my location area or his office location area? Please suggest.

send notice to the office address. Also find out the name and address of the partner/proprietor/directors of the agency. If it is a registered company under the companies Act, you can find out the names of directors from a search in the office of the registrar of companies.

Send legal notice to the office address you have. No question of giving police complaint. Have the assistance of local lawyer in these case specific matters.

You may want to contact a lawyer in your area for pursuing your remedy.

Appropriate action may be taken under the Negoitable Instruments Act.

however, alternatively, a complaint with the local police may also be made.

Legal notice can be send through an Advocate or yourself. however, the important ingredients mentione in the Negotiable Instruments Act has to be kept in mind before preparing the legal demand notice. There is no need to lodge a police complaint for cheque bounce case.
