Yes but you can defend it as contract was void.

Yes,it comes u/s.138 N.I.Act,rest is a matter of trial.

a cheque is presumed to have been issued in discharge of a debt unless the contrary is proved in the trial under Sec.138 N.I.Act. Therefore it is a matter to be agitated in defence when prosecution is filed on dishonour of a cheque.
