Cheque Bounce - not able to know the reason

Hi,

I have recently given a PNB cheque to Axis Bank for the part payment of my Home loan.I got a call from Axis Bank that the cheque has bounced and also they have sent me a letter for the same but the details in the letter are all wrong(my name,Cheque Amount).I have sufficient balance in my account so don't know how the cheque got bounced.Instaed I had written my contact number at the back of the cheque but they(PNB) did'nt call me before rejecting the cheque.Also,they levied a penalty of Rs 225.I have asked Axis Bank to send me the correct details with the return memo from the bank but I have'nt received any response from Axis bank.Also,I have approached my PNB home branch for the reason of rejection of the cheque but they told me that they won't be able to tell the reason as the cheque is rejected directly from the head branch and instead told me to get the reason from Axis Bank.

I also called up PNB Customer care and they told me that the account is inactive but I had depositted a cheque In Dec 2008 but they say that we need to withdraw amount as well.Is it true?I had also requested for a debit card and net banking in January and had also logged online in Jan 2009.Please suggest how to get the cheque bounce reason

send legal notice to pnb. else file your case in consumer court but only after rejection letter from PNB. They will not only pay the charges but also harassment charges.

The only way you have is to approach the Axis Bank and get the reason be because for all cheque bounces the Axis bank will have the reason and based on which a memo is issued by the Axis Bank.

You may write a registered A.D. letter to the bank and if satisfactory information is not received, you may file a complaint with the consumer courts of your area.

you should write a letter/ complaint narrating all the facts through registered post to both the banks,

you can also send a legal notice through lawyer and can also sue the bank in the consumer court for deficiency in services for which they areliable to pay you damages for un-necessary harrasment mental agony etc.

If u don't get a proper reply, apply under the Right to Information Act enclosing a draft for Rs.10/- in favour of the chief Information officer of the PNB branch concerned. If still unsuccessful, appeal to the appellate authority under the RTI Act of the Bank, whose address u can get from the website of the bank. If u feel that your cheque has been improperly returned, give a complaint to the branch concerned claiming damages as well. If they don't respond properly, send notice to the Chief Executive of the Bank i.e the Chairman and M.D. of the Bank. If still your grievance is not redressed, give complaint to the Banking Ombudsman of the Region concerned whose address and details can be ascertained from Reserve Bank of India website. Better take the assistance of a local lawyer.
