Cheque Bounce

Hi Sir,

One of my cheque of 2500/- was bounced 2 years back. But that person did not take any action. SO.. Can he take any legal action now against me? Please reply me asap.

Uptill now if the party did not take any legal action,then the party can not initiate any criminal proceeding but can initiate civil proceeding because the limitation period for initiating civil action is 3 years.Chances of initiating civil action are remote because legal expenses will be more than the cheque amount.

Dear Sir,

That person did not take any legal action against you till date.

He can not file a criminal case for cheque bounsing because it is time barred.

Your cheque is also has no value as it is not valid on expiry of 6 months from the date of issue.

But he can file a civil suit against you for recovery of the due amount.

HI,

has he sent you a notice regarding the dishonour of Cheque. If he has not sent you then he cannot take any action now. There is no cause of action.
