Legal Question in Banking Law in India

cheque

a company issued a cheque to c, the cashier of the company to make the payment of wages to the workers. c discountinued the same with his banker ,United bank of india. but c did disburse the wages .MD of the company's banker to stop payment. UBI claimed the amt , UBI also filed a criminal complain case against MD and the company. plz lst the argument on behalf of UBI.

On the stated facts, it is difficult for UBI to forcibly advance the case as the MD of the Co. would contend that the Bank is not a holder in due course. It can only claim the amount from C the cashier who through discounting the company cheque for his personal use is guilty of conversion. The issues are to be left to be dealt with lawyers of UBI rather than seeking hypothetical answers in this forum.
