Cheque Dishonored due to INSUFFICIENT FUND 2 Times Canceling the Flight ticket

I purchased 3 Jet Airways flight tickets from DELHI�TRIVANDRUM, Travel Date 14/01/2009 vide Bill # 032 (SATNAM TRAVELS J-5/121, RAJOURI GARDEN, NEW DELHI-110027) Dated 06/12/2008,Ticket # NBGF48 for 3 US citizens (relatives) visited Delhi.

1st Default: On 14/01/2009 (Canceling the Flight ticket without informing customer)

2nd Default: On 21/01/2009 (1st Cheque Dishonored due to INSUFFICIENT FUND)

3rd Default: On 03/02/2009 (2nd Cheque Dishonored due to INSUFFICIENT FUND)

Finally on 3rd Feb 2009 I registered a Notice Under section 138 and 142 of the Negotiable Instrument Act,

1881

Still Payment Not Received from him Whate is the Next Step Give 15 Days Completed.

You have two remedies which may be pursued simultaneously ;

(a) File a criminal complaint under the Negotiable Instruments Act r.w. Section 420 of IPC.

(b) File a suit for recovery invoking "Summary Provisions" under C.P.C. alongwith an application for Attachment before Decree seeking to attach assets of the drawer.

you have a month from the expiry of 15 days from the date of receipt of notice of the drawer to file a complaint before the Metropolitan Magistrate. Pl.consult a local lawyer and proceed to file the complaint within time, if in the meanwhile u do not receive payment.

You need to approach to the Court and file a case of recovery.

File a criminal complaint before the Judicial Magistrate First Class or Metropolitan Magistrate.
