Legal Question in Banking Law in India

cheque

sir i issued a cheque to party but i had to pay in case before the date of cheque, isuued by me. the party did not give me any receving of payment. i went to bank and stop the payment. the cheque was issued on fream's name. there was noting on papers. after taking money he file a case also. what should i do. he is saying that he gave me a friendly loan. can he took chaque on frams name.
