Legal Question in Banking Law in
our contract with Sbi came to end on 30/11/2009. the bank didn't gave any notice regarding the termination of the contract but it is mentioned in the service rules for contractual employee that bank will serve the notice of 3 months. We had served the bank for 2 years. Can we have a chance to get our position back in the bank

The answer to your question is unfortunately "No" because the contract employment automatically terminates with 30/11/2009. No need to give prior notice. This is on account of Sec.2(bb) of the Industrial Disputes Act. Make a fervent appeal to SBI to offer you permanent employment. If they relent, well and good. Otherwise, seek employment in other organizations citing your experience with SBI.
