Legal Question in Banking Law in India
Dear Lawgurus,
I am a victim of 138 NI Act. Company send me a Notice u/s 138 NI Act, I receved it on 25.10.10 I respond to that Notice and told them this is not a matter under 138 NI Act. They respond to my reply on 23.11.10 and told me that they are not agree with my view and on same day they filed suit in the court U/S 138 NI Act. Is it a correct legal Possition or they have to give me time after recipt of there letter dated 23.11.10

They don't have to give you time. Fight out the case before the Magistrate.
