Legal Question in Banking Law in India
Dear Sir, My brother had issued cheque to share broker without entering date in 2005 for purpose of buying share. Then such bank account closed by him. Now in 2011 the person presented the cheque in bank with entering amout of 3 lacs and cheque was dishonured because bank account already closed. now he gave us notice regarding this matter. Please help us we can't afford to fight case for so long. what we can do now. He has filed notice in mehsana

reply to the notice that the cheque is not given in discharge of any debt. Also contend t hat ablank cheque has been misused. There is no alternative to fighting out the case. Take the assistance of local lawyer immediately
Yes , you need to show that no such amount was due to be paid to the broking company.
