Legal Question in Banking Law in India
Dear Sir,
I had withdrawn some amount on 30th August, 2010 using my SBI ATM card from ATM of IDBI Bank. IDBI bank's ATM uses system of inserting ATM card in it. I withdrew money and cancelled any further transaction but card didnt come out. In the mean time I forgot to collect my card and left the place. on 2nd September, 2010 I went to its respective branch for the recovery of my card but they denied to give it back to me arguing that it is not in their policy and for safety of the customers. I offered to provide all my documents as an evidence for recovery of the card but they said they would destroy it and will not give it back to me at any cost.
I went to my SBI branch and told everything what IDBI bank's executive told me. SBI office clearly answered that IDBI bank doesnt have any right to destroy the ATM card of other bank and you can recover it by making a simple application attested from SBI brach.
I tried everything but they didnt give my card back. Ultimately, I applied for new ATM card in SBI as I was left with no other choice.
Sir, Was IDBI's conduct appropriate to me denying to give me my card even if i make application with my proofs for the same ? I wish to sue IDBI if u can help me.

file a complaint with Banking ombudsman after serving a notice for damages on IDBI Bank Chairman.and his not making any amends for the deficiency of service of his bank.
