Legal Question in Banking Law in
if the defaulter under section 138 is ready to pay the cheque amount or is ready for settlement during trial what will be the judjement on this?

as per the new judgment of supreme court, if the defaulther pays on the first hearing it will be acquittal without any extra payment. However after some time if he volunteers it would be still acquittal but he has to pay 10% extra.

ACCORDING TO SUPREME COURT THE DEFUALTER MUST APPLY TO COURT FOR THE SAME IN FIRST 15 DAY.
