Legal Question in Banking Law in India
I deposited a HSBC business vantage cheque which was returned back to my bank due to insufficient funds in the HSBC account. I want to take legal action against the account holder and the bank to issue these kind of cheques to people who dont have necessary funds in their accounts.

u can issue notice to the HSBC within one month and then with 15 days file a case of 138 and other proceedings also.

No legal action may be maintainable against the Bank. However, you may pursue your remedy against the cheque drawer.

If Vantage cheque is not a banker cheque, you can proceed against the issuer only.
