Ecs bouncing
Dear sir, If there are any borrower provided us ECS. Which will bounced then whatever the act applecable againsst that Borrower.
Please provied me the details as well as earliest.

It is Negotiable Instrument Act is applicable and for recovery etc.Specific relief Act is applicable.In case of need contact with details.Professional charges are applicable.

You can sue him under the (1) Negotiable Instruments Act {for recovery}, (2) Specific Relief Act.

ECS credit is due to the mandate given by a customer of a bank to his bank to debit his account and make payment to his creditor or authority to whom amount is due. If the ECS mandate is cancelled/revoked or that there are no adequate funds available in the account for the ECS credit to be effected, the only remedy of the party in whose favour the ECS mandate is there is to sue the borrower/obligant in normal civil court.The provisions of Negotiable Instruments Act relating to bouncing of cheques has no application for failure/revocation of ECS credit due to inadequacy of funds in the account.
