fail to provide a job on compassionate ground and providing financial relief
my father was employee in bank of baroda. my father had died on 09/07/2001 during his service period . I had my mom and two sister. After the death of my father the bank sent a letter for the job in
place of father position. As the 18 year of age was not completed and there was policy of the bank that inplace of decreased employee the getthe job for it. I have complete detail of all copies sent my the bank . Bank had also given a letter that son is fit under policy. In Dec,2005 the bank also gave a letter that written test will be taken but the exam was cancelled. In dec,2006 the bank given a letter to go for financial relief . I am not the one that face consequence there are 4 to 5 claim .many of the claimer had taken a financial relief . As family decided to go for financial relief. Is it right to go for the financial relief or to file a petition against bank to get job on compassionate ground? . we are from the poor family so provide valueable information to fight against the injustice .

It is advisable to seek personal consultation with a lawyer at your place who is known for his expertise on labour and writ pleas. Re. compassionate appointment, with the onset of liberalisation Supreme court seems to take into account the reservations of nationalized banks in providing compassionate appointment. From the facts you have set out, it is possible for you to file a writ petition seeking a direction to the Bank to provide you the job. But the laws delays are discouraging. More due to the disproportion in the number of courts to the large number of cases pending and piling every day. It looks to me that it is better to get financial relief and seek your future with some other employer. However it depends on the face to face advice you may receive from a lawyer on personal consultation.
