Double the amount of cheque or 2 years imprisonment or both is the punishment.Yes in criminal proceeding. Send a mandatory notice before filing the complaint with in the stipulated period.

a notice needs to be sent within one month of bouncing of cheque and a complaint needs to be lodged within 45 days of the other party receiving the notice.
